By electing to save your analysis results on the Solana blockchain using the InterPlanetary File System (IPFS) through storacha.network, you (“Client” or “You”) agree to the terms and conditions set forth in this Blockchain Storage Agreement (“Agreement”). This Agreement is a legally binding contract between you and Proofly AI (“We,” “Us,” or “Our”), governing your use of the blockchain storage feature offered as part of our image authenticity verification service. Please read this Agreement carefully before using the blockchain storage feature. By proceeding, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must not use this feature.
1. Overview of the Blockchain Storage Feature
Proofly AI provides a service to verify the authenticity of images using advanced artificial intelligence (AI) models, with results recorded on the Solana blockchain for transparency and immutability. As an optional feature, you may choose to save your analysis results (“Results”), including detected face images and metadata, on IPFS—a decentralized storage system—through storacha.network, which also utilizes Filecoin for long-term storage. This creates a permanent, distributed record of your Results.
Proofly AI does not directly store or manage your data on IPFS or Filecoin. Instead, we act solely as a facilitator, integrating with storacha.network to enable this decentralized storage option. Your use of this feature is therefore subject to both this Agreement and storacha.network’s Terms of Service.
2. Acknowledgment of storacha.network Terms
By opting to use the blockchain storage feature, you acknowledge and agree that:
Your Results will be stored on IPFS and backed by Filecoin via storacha.network’s decentralized storage services.
You are subject to storacha.network’s Terms of Service, including any updates or modifications made by storacha.network.
You have reviewed and agree to comply with storacha.network’s terms, which govern data storage, availability, and your responsibilities as a user.
Proofly AI is not responsible for any aspect of storacha.network’s services, including the storage, availability, integrity, or permanence of your data once it is uploaded to IPFS.
3. Data Storage and Availability
3.1 Decentralized Nature of Storage
Your Results, such as images of detected faces (PNG, 512x512 pixels) and metadata (e.g., hashes, analysis results, verdicts, and confidence levels), will be stored on IPFS and backed by Filecoin through storacha.network.
Due to the decentralized nature of IPFS and Filecoin, Proofly AI cannot control or guarantee the immediate availability, accessibility, or permanence of your data. These factors depend entirely on the operations of the IPFS and Filecoin networks and storacha.network’s services. Data uploaded to IPFS may experience delays in availability and, once stored, may remain accessible indefinitely due to replication across network nodes, even if deletion is attempted. 3.2 No Guarantee of Permanence or Accessibility
While IPFS and Filecoin aim to provide persistent storage, Proofly AI does not guarantee that your data will remain available or intact over time. Availability may be affected by network conditions, node participation, or the expiration of Filecoin storage deals managed by storacha.network.
You acknowledge that Proofly AI is not responsible for any loss, corruption, or unavailability of your Results stored on IPFS or Filecoin.
3.3 Third-Party Web3 Technologies
Proofly AI utilizes third-party web3 technologies, including the Solana blockchain and IPFS via storacha.network, to facilitate the storage of your analysis results. You acknowledge and agree that:
Proofly AI does not control, manage, or guarantee the performance, security, or reliability of these decentralized technologies.
Proofly AI is not responsible for any failures, delays, data loss, corruption, or other issues arising from the use of these third-party services.
Any cryptographic functions (e.g., hashing, digital signatures) are inherent features of the blockchain and IPFS and are not provided, managed, or warranted by Proofly AI. Proofly AI does not engage in the provision of cryptographic services.
By using the blockchain storage feature, you accept all risks associated with these decentralized technologies, including but not limited to network failures, data unavailability, or security vulnerabilities.
4. Your Responsibilities
4.1 Compliance with Applicable Laws
You are solely responsible for ensuring that your use of the blockchain storage feature complies with all applicable laws and regulations, including but not limited to tax obligations, data protection laws, and privacy regulations.
4.2 Data Privacy and Security
Data stored on IPFS is publicly accessible via its Content Identifier (CID). Proofly AI does not store full original images in IPFS — only detected face images and metadata — but you should not upload sensitive or private data in an unencrypted form unless you accept the associated risks. Proofly AI is not liable for unauthorized access to or misuse of your data once it is stored on IPFS or Filecoin. You are responsible for ensuring your data meets your privacy and security needs.
4.3 Understanding Risks
You acknowledge and accept the inherent risks of decentralized storage, including:
Potential loss or corruption of data.
Delays in data availability.
The possibility that data may persist indefinitely on IPFS, even after attempts to remove it.
Limited control over data once uploaded due to the decentralized nature of the system.
5. Limitation of Liability
5.1 No Warranties
The blockchain storage feature is provided “as is” and without any warranties, express or implied. Proofly AI does not guarantee that the feature will be uninterrupted, error-free, or suitable for your specific purposes.
To the fullest extent permitted by law, Proofly AI disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
5.2 Exclusion of Liability
Proofly AI shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the blockchain storage feature, including but not limited to damages for data loss, lost profits, or other intangible losses.
In no event shall Proofly AI’s total liability to you for any claims related to this Agreement exceed the amount you paid Proofly AI for the blockchain storage feature in the six (6) months prior to the claim, or $10, whichever is less.
6. Modifications and Termination
6.1 Changes to the Feature or Terms
Proofly AI reserves the right to modify, suspend, or discontinue the blockchain storage feature at any time, with or without notice, including by transferring its operation to a third party or smart contract.
We may update this Agreement periodically. Material changes will be communicated via email or through our platform. Your continued use of the feature after such notice constitutes acceptance of the updated terms.
6.2 Termination
You may discontinue using the blockchain storage feature at any time, but data already stored on IPFS may remain accessible indefinitely due to the decentralized system. Proofly AI may suspend or terminate your access to this feature at our sole discretion, including for violations of this Agreement or if required by law.
7. Intellectual Property
All rights to the Proofly AI platform, including the blockchain storage feature, remain the property of Proofly AI. This Agreement does not grant you any license to use our trademarks, logos, or proprietary materials beyond the scope of the service.
8. Governing Law and Dispute Resolution
This Agreement is governed by the laws of UAE, excluding its conflict of law provisions. Any disputes arising under this Agreement shall be resolved through binding arbitration in UEA, following the rules of UAE, Dubai. You waive any right to participate in class action lawsuits or class-wide arbitration.
9. Miscellaneous
9.1 Entire Agreement
This Agreement, along with storacha.network’s Terms of Service, constitutes the complete agreement between you and Proofly AI regarding the blockchain storage feature, superseding all prior agreements or understandings.
9.2 Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.
9.3 No Waiver
Failure by Proofly AI to enforce any provision of this Agreement does not constitute a waiver of that provision.
10. Acceptance of Terms
By selecting the option to save your Results on the blockchain via IPFS, you confirm that you have read, understood, and agree to be bound by this Agreement. You must affirmatively accept these terms before proceeding with the blockchain storage feature.
